These General Conditions of Sale shall apply between the company GestiSport C.B. trading as CENTRO DEL DEPORTE .COM (hereinafter "Centro del Deporte .Com"), and any person making a purchase through the website www.centrodeldeporte.com (hereinafter "the customer"), collectively referred to as "the parties".
The parties agree that their relationship will be governed exclusively by these General Conditions of Sale, which are accessible on the website www.centrodeldeporte.com, and must, in any case, be accepted in advance by the customer.
In the event of their modification by Centro del Deporte .Com, the conditions applicable to each customer will always be those accepted at the time of their purchase.
The customer, prior to contracting and in any case during the purchase process, may access, archive, and print these general contracting conditions for consultation.

ARTICLE 1: PURCHASE PROCEDURE
The customer declares to be eighteen years of age and have the legal capacity to make a purchase on the website www.centrodeldeporte.com. The customer agrees to abide by these General Conditions of Sale.
Purchasing through www.centrodeldeporte.com is only available for shipping addresses in Europe. The purchase is made following the steps described below:
1-. Access www.centrodeldeporte.com and connect to the store; you have several possibilities to find an item:
· Visit the section you want to see using the tabs found on the left side of the page.
· Use our search engine.
When you have found the product you want, click on the photo, on the "quick view" icon or on the name to discover the product in detail. Once on the product sheet of your choice, select the different options. Then click on the "Add to cart" button. If you want to continue shopping click on the "Continue shopping" button. If you want to finish shopping and validate your order click on the "Checkout" button.
2-. Cart
You will be able to view the added products to reserve in the cart. In your cart, you can change your quantities or delete the items you do not want. If you wish to finalize the purchase, click on the "Place order" button.
3-. Identify yourself
· If you are a registered user, enter your e-mail and password and click on "Log in".
· If you are a new customer, enter your name, surname, e-mail, and password in the space for new customers, and click "Save". You will then be redirected to a registration form, which you must fill out and validate to be registered.
If you are a Club, School, Company, or any other collective, remember to fill in the Company/Club option and add the tax identification number. These points will ensure that invoices are correctly issued in the name of the Company, Club, or School.
4-. Choose the delivery method
Choose how you want to receive your order.
· Pick up at the warehouse that Centro del Deporte .Com has in Palencia.
· Home delivery: The order will be delivered to the delivery address associated with your customer account.
· Delivery at a convenience point: Enter your zip code to display available points.
The "Pick up at Palencia warehouse" service takes place during regular warehouse hours. The order will be available at the warehouse for 3 calendar days from the moment you receive the pick-up confirmation e-mail.
5-. Validate the cart and choose payment
Check all the details in your cart:
Billing address: if you wish to modify it, click on "Edit".
Shipping address: if you wish to modify it, click on "Edit".

Payment method: Choose the payment method. We currently have the following payment methods available:
- Bank card.
- Bank transfer or deposit.

6-. Payment
· You will be redirected through a secure connection.
· Enter your bank details and validate.
· You will simultaneously receive a response from the bank, indicating whether your authentication request is accepted or denied.
· Click on "return to store" to close the secure connection and return to the www.centrodeldeporte.com website
· You will receive a first e-mail, informing you that your request has been taken into account once the purchase process is complete (the "Order Confirmation").
· You will receive a new e-mail to inform you that your order has been shipped (if fully confirmed) and you will again receive the details of your order and amount (the "Order Dispatch").

7-. Invoice
The user expressly accepts the issuance of the invoice in electronic format, although they may indicate their desire to receive a paper invoice at any time by sending an email to info@centrodeldeporte.com with the subject "Quiero mi factura en papel" (I want my paper invoice); in which case, we will issue and send the invoice in this format to the billing address indicated in your order.

8-. Receipt of your order
· Delivery at the Palencia warehouse: You can pick up the order the same day you processed it. To do this, you will need to contact our customer service at (0034) 644 23 25 00 and make an appointment. Pick-up hours will be between 10:00 and 13:30 in the morning and 17:00 and 19:30 in the afternoon.
· SEUR / GLS will deliver the order to the shipping address indicated at the time of purchase, which may be different from the billing address. If no one is found at the shipping address on the first delivery attempt, SEUR / GLS will try again on the next business day. You can track your order shipment with the tracking number on the website: www.seur.com, www.gls.com. From the website www.centrodeldeporte.com we cannot select a preferred delivery time; to do so you must contact the transport company.
· CORREOS will deliver the order to the shipping address indicated at the time of purchase, which may be different from the billing address. If no one is found at the shipping address on the first delivery attempt, Correos will deposit it at the nearest office and leave a receipt in your mailbox to pick it up. You can track your order shipment with the tracking number on the website: www.correos.es. From the website www.centrodeldeporte.com we cannot select a preferred delivery time; to do so you must contact the transport company.
· If you choose pick up at a Correos office, the order will be delivered to the chosen office. You have 7 days to pick up the order from the office.
The delivery time of the order is indicated approximately on the order, and will also be indicated in the order dispatch e-mail. This delivery time depends on the items you request, as well as the shipping address, and will be provided as an estimate during the shipping process.
The delivery time will in no case exceed thirty (30) calendar days from the date of confirmation of your order, with the exception of personalized orders whose delivery times may vary from the agreed time.
The transport company may vary at the choice of Centro del Deporte .Com depending on the ordered products.
If the order cannot be delivered, it will be returned to Centro del Deporte .Com. If this occurs, shipping costs will not be refunded. If we have to resend the order to you, we will charge the shipping costs again.

9-. Exchange and return policy
· To make an exchange and/or return you can go to our warehouse in Palencia, at one of our stands at competitions, or do it through the Online store. The deadline for exchanges or returns of products purchased at our Palencia warehouse, online store, or any of our stands at competitions is 15 calendar days, strictly upon presentation of the receipt or purchase invoice.
· Refunds will always be made using the same payment method used for the purchase (transfer, loyalty voucher, gift card, cash, promotional code, PayPal, etc.).
· Returns of online purchases made using the "Delivery at our Palencia warehouse" service must be made at the Palencia warehouse. After the collection period has passed, if the customer does not go to the Palencia warehouse, they must contact our customer service to proceed with the refund of the amount.
· Returns of the following products are not allowed:
o Goods made to the consumer's and user's specifications or clearly personalized.
o Goods that may deteriorate or expire rapidly.
o Sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery.
o Goods that are not in perfect condition, have been unsealed, or do not have all the objects/papers with which they were delivered.
ARTICLE 2: THE PRODUCTS
The website www.centrodeldeporte.com attempts to reflect, as accurately as possible, both the technical and aesthetic characteristics of the products, although the customer must bear in mind that there may be slight differences between the online appreciation of the product and the physical product.
Stringing machines are delivered in their box, disassembled, with their assembly instructions manual.

Centro del Deporte .Com is liable for any lack of conformity that becomes apparent in the items within two years from the delivery date, in accordance with the terms established in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
ARTICLE 3: THE PRICES
The prices set on the website www.centrodeldeporte.com are indicated in euros, including VAT for each of them. Prices are shown excluding their shipping costs, being valid for the Iberian Peninsula and the Balearic Islands. For purchases from territories with different taxes than those applicable to the peninsula, please contact us.
The Retail Price of the item will always be indicated at the time the customer has completed their shopping cart, and the customer will be informed of the final price of their purchase before validating the payment. Prices may change at any time, but any changes will not affect orders or purchases for which the user has already received an order confirmation.
The shipping costs for each order are calculated in real-time generally based on the weight and dimensions of the customer's shopping cart, as well as their delivery address.
In any case, the shipping costs will be recalculated at all times when making the purchase on the web, and will appear at all times in the customer's shopping cart, clearly differentiated from the price of the item(s) included in it.

ARTICLE 4: AVAILABILITY
Centro del Deporte .Com, undertakes, from the purchase request made by the customer, to take their request into consideration and will proceed, where appropriate, to validate/confirm totally, partially, or nullify the purchase, so that the customer can accept the purchase and formalize it.
Centro del Deporte .Com undertakes to notify the customer of the status of their order, via e-mail, phone call and/or order update in the customer's personal space, which can be accessed by clicking on "My Account".
In the event that the purchase confirmation covers all the selected products, Centro del Deporte .Com will contact the customer by email, informing them of the products purchased as well as the transport price and the status of the order. Centro del Deporte .Com will archive the electronic document formalizing the purchase contract, and it will be accessible to the customer through the My Account link. The purchase contract will be formalized in Spanish.
In the event that the purchase confirmation occurs partially due to the lack of availability of some selected products, Centro del Deporte .Com will contact the customer to inform them of the products finally affected by the purchase via email, phone, and/or through the order update in the customer's personal space, accessed by clicking on "My account". Centro del Deporte .Com will archive the electronic document formalizing the purchase contract, and it will be accessible to the customer through the My Account link. The purchase contract will be formalized in Spanish.
In the event that the purchase confirmation does not occur due to the lack of availability of all the selected products, Centro del Deporte .Com will inform the customer that their purchase cannot be completed by phone, email, and/or through the order update in the customer's personal space, accessed by clicking on "My account".
In the event that it is not possible to execute the contract due to the lack of availability of the selected products, Centro del Deporte .Com will refund any amounts paid by the customer under it as soon as possible.
ARTICLE 5: RIGHT OF WITHDRAWAL
The buyer may freely withdraw from the contract within fifteen (15) calendar days. These periods shall be counted from the date of delivery of the product; that is, from the date of receipt of the purchase.
The customer will have the possibility at all times to waive the purchase made, even after confirmation by www.centrodeldeporte.com, following any of these procedures:
· By sending an e-mail to info@centrodeldeporte.com, indicating the following information: personal data and customer's address; order number and date of acquisition of the order.
· Through the personal space of "My Account", which you can access from the following link.
· Through the Centro del Deporte .Com Customer Service, via the contact page, or by calling (0034) 644 23 25 00 (Monday to Friday from 10 am to 1:30 pm and from 5 pm to 7:30 pm).
Once the declaration of withdrawal is received, Centro del Deporte .Com will confirm its receipt to the customer by sending an email.
In the event that the customer exercises their right to return or withdraw from the purchase made, Centro del Deporte .Com will refund the amount previously charged to the customer, excluding delivery costs, within a maximum of fifteen (15) working days from the date it is informed of the decision to withdraw. If, when making a return, the rest of the order does not reach 100 euros (only for Spain), the shipping costs for the return will be deducted. The refund of the amount will be made using the same payment method, unless the customer expressly indicates another method and this is accepted by Centro del Deporte .Com.
Furthermore, the customer is informed that the transport costs associated with the return will be borne by the customer, so said collection service will not be free of charge.
The customer will only be responsible for the decrease in value of the goods resulting from handling them other than what is necessary to establish their nature, characteristics, or functioning.

ARTICLE 6: RESPONSIBILITIES
The availability of products in the online store stock query, during the "Pick up at Palencia warehouse" process, and during the online store purchase process, is mentioned as an indication and will therefore not have a contractual nature, since purchases may be taking place at the same time and result in the product being unavailable.
Centro del Deporte .Com will not be responsible for any damages that the use of the internet network may cause to the customer (such as viruses, etc.).
In the event that the selected products require the personalization service, the user guarantees that the image, name, brand, logo, or design, etc. provided for the manufacture of the product is their exclusive property and therefore, they hold all the intellectual and industrial property rights granted by applicable legislation, including those of reproduction, distribution, commercialization, or transformation, and consequently, manufacturing a product with said image, brand, logo, or design, etc. does not violate any intellectual or industrial property right of any third party. If the user is not the owner of the image, name, brand, logo, or design, etc., they shall guarantee that they have been granted a right in writing for its use and reproduction, and therefore, the manufacture of a product with said image, brand, logo, or design, etc. does not violate any intellectual or industrial property right of any third party. Centro del Deporte .Com reserves the right to request from the user the documentation it considers necessary to prove the aforementioned statements without being responsible for any damage, harm, or liability derived from the above as a consequence of the falsity or inaccuracy of the aforementioned statements. The website, including but not limited to its programming, editing, compilation, and other elements necessary for its operation, the brands, trade names, images, graphic or photographic designs, files, sounds, animations, logos, text, or whatever their format, as well as the domain name www.centrodeldeporte.com, are the property of Centro del Deporte .Com, or it has an express license or authorization from the authors. All the contents of the website are duly protected by intellectual and industrial property regulations, as well as registered in the corresponding public registers.

With the purchase of an electrical and electronic appliance, the collection of the discarded equipment and equivalent or that performs the same functions as the purchased appliance is carried out free of charge. Said collection takes place at the time of delivery of the new equipment to the customer's home, or it can be delivered to the Centro del Deporte .Com warehouse in Palencia within 30 calendar days of the purchase of the equipment, upon presentation of the corresponding purchase invoice.
To request home collection, the user must send an email to info@centrodeldeporte.com indicating the following information:

· In the body of the email:
o ONLINE ORDER NUMBER: XRIKxxxxxx
o Type of device delivered:
o Brand.
o Serial number, if possible.
ARTICLE 10: COMPLETENESS
If one or more provisions of these general conditions of sale are declared void pursuant to the application of a law, regulation, or following a final judicial or administrative decision, the remaining provisions will retain their validity and scope.
The fact that one of the parties has not demanded the application of any clause of these conditions permanently or temporarily, cannot under any circumstances be considered as a waiver of said clause.
ARTICLE 11: APPLICABLE LAW. DISPUTE RESOLUTION
These general purchasing conditions are subject to Spanish legislation.
For the resolution of all disputes or issues related to this website or the activities developed therein, Spanish legislation will apply, to which the parties expressly submit, with the Courts and Tribunals of Palencia being competent for the resolution of all conflicts arising from or related to its use.
